These Website Standard Terms And Conditions Agreement shall govern terms and conditions of use of materials and services on vita-udin.com web-site (hereinafter referred to as “the Website”).
1. Terms and definitions
User – refers to you, the person log on this website (no matter if registered or not).
Content – content that is encountered as part of the user experience on website.
Order finalization – filling out “Shopping cart” by the User basing upon the products assortment available on the Website, specification of the quantities of products, selection of payment methods, delivery methods from the options available, performed by means of filling-out a special form on the Website.
2. General terms and conditions
2.1. Usage of materials and services of the Website shall be governed by the current laws of the Russian Federation.
2.2. This Agreement is a public offer. Having access to the Website materials, the User shall be deemed as part hereof.
2.3. The Website administration shall be entitled to change terms and conditions of the present Agreement anytime and without notice. These changes come into effect after 3 (three) days after the new version of the Agreement was posted on the Website. If the user is not satisfied with the above changes, he/she shall stop using the Website’s materials and services.
3. User Obligations
3.1. The User shall be obliged not to take actions, which may be regarded as breaking the Russian laws or international regulations, including the ones related to intellectual property, copyrights and/or associated rights, as well as any actions, which result or may result in damage to the normal Website operation and services thereof.
3.2. Using the Website materials with no consent of the right-owners shall not be permitted (Art. 1270 of the Civil Code of the Russian Federation). In order to use the Website materials on a legal basis, one shall conclude license agreements (acquire licenses) with the Right-owners.
3.3. When quoting the Website materials, including protected author works, reference to the Website is obligatory (sub-paragraph 1 of paragraph 1 of Art. 1274 of the Civil Code of the Russian Federation).
3.4. Comments and other records made by the User on the Website shall not come into conflict with the requirements of the laws of the Russian Federation and universal moral and ethics principles.
3.5. The User understands that the Website Administration shall not be held liable for the external resources the Website may include references to.
3.6. The User agrees that the Website Administration shall not be held liable and has neither direct nor indirect obligations to the User connected with any possible or occurred damage or loss associated with any content of the Website, copyright registration and information thereof, products or services available on or received from the external websites or resources or any other contacts of the User initiated when using information of links to the external resources posted on the Website.
3.7. The User agrees that all the materials and services of the Web-site or any part thereof may be accompanied by the advertisement. The User agrees that the Website Administration shall not be held liable and have any obligations related to the advertisement.
4. Other terms and conditions
4.1. All the possible disputes arising from this Agreement and related thereto, shall be subject to the resolution in accordance with the current laws of the Russian Federation.
4.2. Nothing in this Agreement shall be deemed as setting any agent, partnership, cooperation, employment or any other kinds of relations between the User and the Website Administration unless expressly regulated hereby.
4.3. Should any provision hereof be acknowledged by court as non-effective or non-subject to enforcement, this shall not be deemed as the other provisions hereof being non-effective.
4.4. Failure of the Website Administration to act in case any of the Users breaks any provision hereof, shall not deprive the Website Administration of the right to take any actions later in order to protect its interests and copyrights for the Website materials protected by the law.
The User hereby agrees that he/she read and understood all the provisions of this Agreement and unconditionally accepts them.
